1. Agreement to Terms

Welcome to Abujasub Data ("we," "our," or "us"). These Terms and Conditions ("Terms", "Terms of Use", "End User License Agreement" or "EULA") govern your access to and use of the Abujasub Data mobile application (available on Android and iOS) and all related Virtual Top-Up (VTU), digital wallet, airtime purchase, data bundle, cable TV subscription, and utility bill payment services (collectively, the "Services").

By creating an account, downloading, installing, or using the Abujasub Data mobile application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the application.

2. Eligibility & Account Registration

A. Age & Capacity

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal capacity to enter into a binding contract to create an account and use our Services.

B. Account Accuracy & Security

  • You agree to provide accurate, current, and complete information during registration.
  • You are solely responsible for maintaining the confidentiality of your account login credentials, PIN, and password.
  • You are fully responsible for all activities, transactions, and instructions processed under your account.
  • If you suspect any unauthorized access to your account, you must notify us immediately at support@abujasubdata.com.

C. Biometric Authentication & Local Security

Abujasub Data offers optional on-device Biometric Lock (Fingerprint / Face ID / Touch ID) for quick and secure app access. You acknowledge that enabling biometrics relies on your device hardware, and any biometric profile registered on your device will be able to unlock the application.

3. Services & Transactions

A. Virtual Top-Up (VTU) Services

Abujasub Data facilitates instant digital purchases, including but not limited to:

  • Airtime purchases across all supported mobile telecommunication networks.
  • Mobile data bundle subscriptions.
  • Cable television subscriptions (e.g., DStv, GOtv, Startimes).
  • Electricity utility bill payments and meter tokens.

B. Accuracy of Inputs

You are strictly responsible for verifying the accuracy of recipient phone numbers, meter numbers, smartcard numbers, and transaction amounts prior to authorizing payment. Transactions processed with incorrect details provided by the user cannot be reversed once processed by the telecom network or utility provider.

C. Service Delivery & Vendor Gateways

While we strive for 100% instant fulfillment, delivery of airtime, data, and bill tokens depends on telecom network operators and third-party API gateways. Occasional service delays or network downtime may occur. In cases of pending or failed transactions where funds were debited, our automated system or support team will credit your wallet upon transaction confirmation.

4. Wallet & Payments

A. Wallet Funding

  • You can fund your Abujasub Data wallet using assigned virtual bank accounts or other integrated payment options.
  • All funds deposited into your wallet remain available for purchasing Services through the app.

B. Charges & Fees

Applicable service charges, convenience fees, or transaction costs (if any) will be clearly displayed prior to transaction confirmation.

C. Refund Policy

  • Failed Transactions: If a transaction fails and your wallet is debited without service delivery, your wallet will be automatically refunded upon system reconciliation.
  • User Input Errors: Refunds will NOT be issued for transactions successfully processed to an incorrect phone number or meter number entered by the user.
  • Wallet Balance Cash-Out: Wallet balances are intended for service consumption within the app. Any approved manual wallet refund to an external bank account may be subject to administrative processing fees and identity verification.

5. Prohibited Conduct

You agree NOT to use Abujasub Data for any unlawful or improper purposes. Prohibited activities include:

  1. Fraud & Money Laundering: Utilizing the platform for fraudulent activities, illegal fund transfers, carding, or money laundering.
  2. System Abuse: Attempting to exploit software vulnerabilities, reverse-engineer the mobile app, perform automated scraping, or overload server infrastructure.
  3. Unauthorized Access: Accessing or attempting to access another user's account, personal data, or wallet.
  4. False Claims: Filing fraudulent chargebacks or misrepresenting transaction statuses.

Violation of prohibited conduct rules will result in immediate account suspension, wallet freeze, and escalation to law enforcement agencies.

6. Intellectual Property Rights

All rights, titles, and interests in and to the Abujasub Data mobile application, including graphics, code, branding, logos, trademarks, and user interfaces, belong exclusively to Abujasub Data or its licensors. You are granted a non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use in accordance with these Terms.

7. Limitation of Liability & Disclaimers

A. "As-Is" Service Provision

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

B. Limitation of Damages

To the maximum extent permitted by law, Abujasub Data, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or service interruptions arising from:

  • Network downtime or service delays caused by third-party telecom operators or utility vendors.
  • User errors in entering recipient details.
  • Unauthorized access to your account resulting from compromised user credentials.

8. Account Termination & Suspension

We reserve the right to suspend, restrict, or terminate your account at our sole discretion, without prior notice, if:

  • You breach any provision of these Terms.
  • Required by legal, regulatory, or law enforcement authorities.
  • We detect suspicious, fraudulent, or abusive transaction activity.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes, controversies, or claims arising out of or relating to these Terms or the use of the Services shall be settled amicably through customer support. If unresolved, disputes shall be submitted to binding arbitration under the applicable arbitration laws of Nigeria.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Updated versions will be published within the mobile application with an updated "Effective Date". Continued use of the Services following any updates constitutes your acceptance of the revised Terms.
